Este trabalho analisa a influência tributária na definição do modelo constitucional de atribuição dos resultados econômicos da exploração do petróleo offshore, no Brasil. Além da abordagem constitucional do tema, destaca-se a participação dos entes federativos estaduais nas rendas da produção de petróleo, sua federalização e, em decorrência, a redução das rendas dos entes federativos subnacionais, implicando num movimento compensatório pela via da utilização de elementos de natureza tributária, tais como o extinto Imposto Único sobre Minerais e o regime constitucional especial (...) de cobrança na origem do ICMS devido nas operações de combustíveis e derivados de petróleo. O tema é discricionariedade nas teorias do positivismo antes e depois de Dworkin desde a crítica hermenêutica do direito e sua teoria da decisão. O problema é: há a possibilidade de uma teoria da decisão no positivismo, seja ele qual for, mantendo-se intactos os seus princípios metodológicos da descrição e da separação entre direito e moral? O objetivo é apresentar a crítica hermenêutica do direito e sua oposição à discricionariedade dos positivismos. A conclusão é a de que a crítica hermenêutica (...) não é apenas negativa com relação aos positivismos, ela é também positiva e construtiva de uma teoria da decisão. (shrink)

O presente trabalho objetiva fazer uma análise sobre algumas das principais temáticas elaboradas pelo pensador argentino Luis Alberto Warat, quais sejam: o antropofagismo waratiano, o reencontro com a subjetividade perdida e a carnavalização. Para isso, analisou- se uma das obras mais caras do pensamento waratiano: A ciência jurídica e seus dois maridos. Buscou-se através da análise empreendida, elaborar uma crítica sobre paradigmas tradicionais de ciência, incluindo aqui, a própria Ciência do Direito. Sobreleva-se o caráter de indisciplina das atividades artístico-literárias para (...) insinuar as falhas históricas das disciplinas bem instituídas, do pensamento e da cultura dominantes. IntroductionHistory of depression symptoms, including before and during pregnancy, has been identified as an important risk factor for postpartum depression symptoms. This condition has also been associated with diverse implications, namely, on the quality of mother–infant bonding. Moreover, the role of self-criticism on PPD has been recently found in several studies. However, the link between these factors has not been explored yet. Furthermore, anxiety symptoms in postpartum has been less studied.MethodsThis study analyzed whether the history of depression symptoms predicted mother–infant (...) bonding, via self-criticism and PPD symptoms. The same model was repeated with a history of anxiety and postpartum anxiety symptoms. A total of 550 mothers of infants <24 months old participated in this cross-sectional study and answered an online survey.ResultsThrough a parallel–serial mediation model, the results show that in a first step, self-criticism dimensions of inadequate-self, hated-self, and reassuring-self, and in a second step, PPD symptoms, mediate the relationship between the history of depression symptoms and mother–infant bonding. However, the relationship between the history of anxiety symptoms and bonding is not mediated by all the considered chain of mediators, being only mediated by one of the self-criticism dimensions, inadequate self.ConclusionsThe current study confirmed the association of history of both depression and anxiety with mother–infant bonding. While in the case of history of anxiety symptoms, the relation was only mediated by inadequate self-dimension of self-criticism, in the case of history of depression symptoms, the relation was mediated by self-criticism and postpartum depressive symptoms. The buffering effect of reassuring-self on bonding and negative affect was also evidenced. Psychological and preventive interventions should address this evidence to target interventions for mother–infant bonding problems in accordance with previous and actual current maternal risk factors. Two famous negative results about da Costa’s paraconsistent logic ${\mathscr {C}}_1$ (the failure of the Lindenbaum–Tarski process [44] and its non-algebraizability [39]) have placed ${\mathscr {C}}_1$ seemingly as an exception to the scope of Abstract Algebraic Logic (AAL). In this paper we undertake a thorough AAL study of da Costa’s logic ${\mathscr {C}}_1$. On the one hand, we strengthen the negative results about ${\mathscr {C}}_1$ by proving that it does not admit any algebraic semantics whatsoever in the sense (...) of Blok and Pigozzi (a weaker notion than algebraizability also introduced in the monograph [6]). On the other hand, ${\mathscr {C}}_1$ is a protoalgebraic logic satisfying a Deduction-Detachment Theorem (DDT). We then extend our AAL study to some paraconsistent axiomatic extensions of ${\mathscr {C}}_1$ covered in the literature. We prove that for extensions ${\mathcal {S}}$ such as ${\mathcal {C}ilo}$ [26], every algebra in ${\mathsf {Alg}}^*({\mathcal {S}})$ contains a Boolean subalgebra, and for extensions ${\mathcal {S}}$ such as,, or [16, 53], every subdirectly irreducible algebra in ${\mathsf {Alg}}^*({\mathcal {S}})$ has cardinality at most 3. The Belnap–Dunn logic is a well-known and well-studied four-valued logic, but until recently little has been known about its extensions, i.e. stronger logics in the same language, called super-Belnap logics here. We give an overview of several results on these logics which have been proved in recent works by Přenosil and Rivieccio. We present Hilbert-style axiomatizations, describe reduced matrix models, and give a description of the lattice of super-Belnap logics and its connections with graph theory. We adopt the point of (...) view ofAlgebraic Logic, exploring applications of the general theory of algebraization of logics to the super-Belnap family. In this respect we establish a number of new results, including a description of the algebraic counterparts, Leibniz filters, and strong versions of super-Belnap logics, as well as the classification of these logics within the Leibniz and Frege hierarchies. After the publication of Hart's Concept of Law, Dworkin published his article “The Model of Rules,” dividing positivism into two varieties: inclusive and exclusive. Many theorists involved in this debate have characterized Hart's position as inclusivist, which we reject in this article. We argue that Hart, in the postscript to The Concept of Law, conceded a point to Dworkin in accepting that inclusive positivism would imply the existence of objective moral standing, adopting a more “neutral” position—compatible with inclusive and exclusive (...) positivism—and consequently distancing himself from the incorporation thesis, which is paramount to inclusive positivism. ABSTRACT In this research,1 we aim to analyze how misogyny establishes itself in an interaction on X (formerly Twitter) to legitimize hate speech, under the argument of opinion defense. Theoretically, in light of Interactional Sociolinguistics and Pragmatics, we conceive that impoliteness strategies contribute to the construction of linguistic-discursive violence scenarios in online-mediated interactions, as they both reduce interlocutive distance and generate sexist, misogynistic, patriarchal, and antifeminist metapragmatics. Methodologically, we adopted a qualitative approach to analyze an interaction on X based on (...) the inclusion and exclusion criteria proposed in this study, using the netnographic method. Analytically, we observed that interlocutors C, E, and F frequently used impoliteness strategies in constructing opinion-based discourses to attack feminism and legitimize hate speech. (shrink)

Neste artigo, meu objetivo é analisar de que maneira o cientista, no âmbito das Ciências Naturais, é educado para assimilar, aplicar e articular um determinado paradigma na solução dos problemas de ciência normal, sem colocá-lo (o paradigma) criticamente em questão, assim qualquer erro que venha a ocorrer na pesquisa é atribuído ao cientista e não ao paradigma. Pretendo também, mostrar que o caráter dogmático do paradigma não permite que o cientista desenvolva pesquisas visando novas descobertas que não se enquadrem nos (...) parâmetros ditados pelo mesmo, tal atitude exige total aceitação e comprometimento da comunidade científica para com o paradigma aceito, gerando assim, uma espécie de profissão de fé na capacidade do paradigma em resolver os quebra-cabeças que se apresentam na prática da ciência normal. Human rights have become an important ideal in current times, yet our age has witnessed more violations of human rights than any previous less enlightened one. This book explores the historical and theoretical dimensions of this paradox. Divided into two parts, the first section offers an alternative history of natural law, in which natural rights are represented as the eternal human struggle to resist opression and to fight for a society in which people are no longer degraded or despised. At (...) the time of their birth in the 18th Century and again in the popular uprisings of the last decade, human rights became the dominant critique of law and society. The radical rhetoric of rights and its apparently endless expansive potential has led to its adoption by governments and individuals alike seeking to justify their actions on moral grounds and has undermined its radical edge. Part Two examines the philosophical logic of rights. The classical critiques of Kant, Burke, Hegel and Marx illuminate traditional aproaches to the concept of human rights. The work of Heidegger, Sartre and psychoanalysis is used to deconstruct the metaphisical essentialism of bothe universalists and cultural relativists. Finally, through a consideration of the ethics of otherness, and with reference to recent human rights violations, it is argued that the end of human rights is to judge law and politics from a moral stand point which both transcends the present and is historically relevant. The purpose of the present paper is to consider the traditional interpretive problems of quantum mechanics from the viewpoint of a modal ontology of properties. In particular, we will try to delineate a quantum ontology that (i) is modal, because describes the structure of the realm of possibility, and (ii) lacks the ontological category of individual. The final goal is to supply an adequate account of quantum non-individuality on the basis of this ontology.

A emoção sempre foi definida como um estado afetivo que se contrapõe à cognição ou à atividade racional. Tal distinção é hoje radicalmente negada pelas pesquisas em neurociências. As emoções, stricto sensu, se expressam sob forma de manifestações intensas, abruptas, inesperadas. Convém, por isso, reconhecer que a emoção envolve uma experiência sensorial e uma dimensão comportamental ou expressiva representada pela resposta motora que ela suscita . Assim, as emoções comportariam sentimentos e/ou atitudes , cujas manifestações variam segundo a intensidade, as (...) circunstâncias e a natureza dos agentes desencadeadores. Dessa gama enorme de possibilidades depende a caracterização precisa dos estados mentais que tais sensações suscitam e as formas de conduta que elas engendram. A atitude emocional, todavia, nem sempre se distingue do comportamento voluntário, aquele guiado pela decisão do agente. Algumas emoções não somente desencadeiam certas formas de comportamento, como são modos apropriados de os indivíduos se adaptarem às situações vividas. É dessa interação que trata o nosso trabalho. Jurisprudence is the prudence of jus, law's consciousness and conscience. Throughout history, when thinkers wanted to contemplate the organisation of society or the relationship between authority and the subject, they turned to law. All great philosophers, from Plato to Hobbes, Kant, Hegel, Marx and Weber had either studied the law or had a deep understanding of legal operations. But jurisprudence is also the conscience of law, the exploration of law's justice and of an ideal law or equity at the bar (...) of which state law is always judged. Jurisprudence brings together 'is' and 'ought', the positive and the normative, law and justice. But after a long process of decay, legal theory is today characterised by cognitive and moral poverty. Jurisprudence has become restricted and academically peripheral, a guidebook to technocratic legalism and a legitimation of the existent. Critical jurisprudence returns to the classical tradition of a general philosophy of law and adopts a much wider concept of legality. It is concerned both with posited law and with the law of the law. All legal aspects of the economic, political, emotional and physical modes of production and reproduction of society are part of critical jurisprudence. This widening of scope allows a radical rethinking of the nature of rights, justice, sovereignty and judgement. A political philosophy of justice today must examine the political economy of law; transitions from Empire to nation; ideological and imaginary constructions through which we understand ourselves and relate to others; ways in which gender, race or sexuality create forms of identity that both discipline bodies and offer sites of resistance. Law's complicity with political oppression, violence and racism has to be faced before it is possible to speak of a new beginning for legal thought, which in turn is the necessary precondition for a theory of justice. Critical Jurisprudence offers an ethics of law against the nihilism of power and an aesthetics of existence for the melancholic lawyer. (shrink)

The concept of fitness, central to population genetics and to the synthetic theory of evolution, is discussed. After a historical introduction on the origin of this concept, the current meaning of it in population genetics is examined: a cause of the selective process and its quantification. Several difficulties arise for its exact definition. Three adequacy criteria for such a definition are formulated. It is shown that it is impossible to formulate an adequate definition of fitness respecting these criteria. The propensity (...) definition of fitness is presented and rejected. Finally it is argued that fitness is a conceptual device, a useful tool, only for descriptive purposes of selective processes, changing from case to case, and thus devoid of any substantial physical counterpart. Any attempt to its reification is an apport to the metaphysical load evolutionary theory has inherited from Natural Theology. (shrink)

The current crisis is one outcome of the financialisation of contemporary capitalism. It arose in the USA because of the enormous expansion of mortgage-lending, including to the poorest layers of the working class. It became general because of the trading of debt by financial institutions. These phenomena are integral to financialisation. During the last three decades, large enterprises have turned to open markets to obtain finance, forcing banks to seek alternative sources of profit. One avenue has been provision of financial (...) services to individual workers. This trend has been facilitated by the retreat of public provision from housing, pensions, education, and so on. A further avenue has been to adopt investment-banking practices in open financial markets. The extraction of financial profits directly out of personal income constitutes financial expropriation. Combined with investment-banking, it has catalysed the current gigantic crisis. More broadly, financialisation has sustained the emergence of new layers of rentiers, defined primarily through their relation to the financial system rather than ownership of loanable capital. Finally, financialisation has posed important questions regarding finance-capital and imperialism. (shrink)

This paper presents a unified framework that explains and extends the already successful applications of the Leibniz operator, the Suszko operator, and the Tarski operator in recent developments in abstract algebraic logic. To this end, we refine Czelakowski’s notion of an S-compatibility operator, and introduce the notion of coherent family of S-compatibility operators, for a sentential logic S. The notion of coherence is a restricted property of commutativity with inverse images by surjective homomorphisms, which is satisfied by both the Leibniz (...) and the Suszko operators. We generalize several constructions and results already existing for the mentioned operators; in particular, the well-known classes of algebras associated with a logic through each of them, and the notions of full generalized model of a logic and a special kind of S-filters. We obtain a General Correspondence Theorem, extending the well-known one from the theory of protoalgebraic logics to arbitrary logics and to more general operators, and strengthening its formulation. We apply the general results to the Leibniz and the Suszko operators, and obtain several characterizations of the main classes of logics in the Leibniz hierarchy by the form of their full generalized models, by old and new properties of the Leibniz operator, and by the behaviour of the Suszko operator. Some of these characterizations complete or extend known ones, for some classes in the hierarchy, thus offering an integrated approach to the Leibniz hierarchy that uncovers some new, nice symmetries. Responding to Alain Badiou’s ‘communist hypothesis’, the leading political philosophers of the Left convened in London in 2009 to take part in a landmark conference to discuss the perpetual, persistent notion that, in a truly emancipated society, all things should be owned in common. This volume brings together their discussions on the philosophical and political import of the communist idea, highlighting both its continuing significance and the need to reconfigure the concept within a world marked by havoc and crisis.

The aim of this essay is to present a reading of Plato's utopianism, as expressed mainly through the 'big letters' of the Republic, which will lead us beyond Karl Popper's and Leo Strauss' modernist understandings of Plato and of his world. The author argues that, despite the 'transcendent' aspects of Platonic utopianism, the ideal city should be understood neither as a blueprint to be realized through some totalitarian political project nor as a mere fiction that cannot by definition give rise (...) to a viable existential prospect. The power of Platonic utopianism lies in its articulation to a value-laden cosmological continuum, which may be understood in terms of the self-instituting (through political persuasion and story-telling activites, among others) capacities of ancient Greek city. The utopian perspective is marked by shareability of political reason and by mutuality between participants in a common discursive venture rather than by individualist authoritarian projections or by harmless (that is, non-political in it orientation and ideological in its repercussions) day-dreaming. Even if Plato's philosophical project aspires to transcend the boundaries of ancient Greek cosmos, Platonic politics cannot be separated from its historical context, that is, the circumstances that gave rise to philosophy as a silent perhaps, but revolutionary, in it intentions political act. O liberalismo português iniciou o seu longo período de implantação com a Revolução de 24 de Agosto de 1820 e com a aprovação, dois anos depois, da Constituição de 1822, a primeira lei fundamental do país, que deu começo à construção do seu Estado de Direito. Nos dezoito anos seguintes, Portugal aprovaria mais duas constituições (1826 e 1838), correspondendo, cada uma delas, a um paradigma do constitucionalismo liberal de oitocentos. This paper explores a notion of “the strong version” of a sentential logic S, initially defined in terms of the notion of a Leibniz filter, and shown to coincide with the logic determined by the matrices of S whose filter is the least S-filter in the algebra of the matrix. The paper makes a general study of this notion, which appears to unify under an abstract framework the relationships between many pairs of logics in the literature. The paradigmatic examples are (...) the local and the global consequences associated with a normal modal logic, and the logics preserving degrees of truth and preserving truth associated with certain substructural and many-valued logics. For protoalgebraic logics the results in the paper coincide with those obtained by two of the authors in 2001, so the main novelty of the approach is its suitability for all kinds of logics. The paper also studies three kinds of definability of the Leibniz filters, and their consequences for the determination of the strong version. In a second part of the paper several case studies are developed, comprising positive modal logic, Dunn–Belnap’s four-valued logic, the large family of substructural logics, and some relevance logics. It is becoming clear that many of today’s management theories are inadequate theoretically and practically to move understanding, scholarship, and practice to where it needs to be for scholars, business leaders, and policy makers to cope with an increasing fraught world. This Special Issue’s focus is on sustainability. Sustainability challenges need to incorporate multidisciplinary interventions and the trans- and interdisciplinary nature of solutions. To actively seek transformation toward sustainability, fundamental and innovative short-term as well as long-term efforts are required in (...) society, economy, technology, and education, including our understanding of human behavior and attitudes toward the management of the environment. The scientific community has debated the importance of “return” activities after ethnobiological studies. This issue has provoked debate because it touches on the ethics of research and the relationships with the people involved in these studies. This case study aimed to investigate community perception of an ethnobotany research project that was carried out in the semi-arid region of northeastern Brazil. Furthermore, we reported how the residents of this rural community felt about participating in the activities of “return” that arose from (...) the projects. Our findings demonstrate that “return” activities should be planned from the design phase of the research until its closure as a lifelong process that allows the communities involved to gradually take ownership of the information and actions that are being generated. Similarly, we argue that such activities must be negotiated with the people of the community so that they have decision-making power and autonomy to decide what is most relevant to their lives. We investigate the higher-order modal logic , which is a variant of the system presented in our previous work. A semantics for that system, founded on the theory of quasi sets, is outlined. We show how such a semantics, motivated by the very intuitive base of Schrödinger logics, provides an alternative way to formalize some intensional concepts and features which have been used in recent discussions on the logical foundations of quantum mechanics; for example, that some terms like 'electron' have (...) no precise reference and that 'identical' particles cannot be named unambiguously. In the last section, we sketch a classical semantics for quasi set theory. (shrink)

One of the most common strategies in philosophical dispute is that of accusing the opponent of begging the question, that is, of assuming or presupposing what is to be proved. Thus, it happens quite often that the credibility of a philosophical argument is infected by the suspicion of begging the question. In many cases it is an open question whether the suspicion is grounded, and the answer lurks somewhere in the dark of what the proponent of the argument does not (...) say. This is why it may take years, or even centuries, before the begging of the question is brought to light. But few philosophers would deny that once it is established that a certain argument begs the question, that argument has to be rejected without hesitation: question-begging arguments are bad arguments, hence one should not appeal to them. Logicians traditionally classify begging the question as a fallacy, that is, as a bad reasoning that seems good at first sight. The fallacy is known under the name of petitio principii. This paper originated in our dissatisfaction with definitions of petitio principii found here and there in logic textbooks. Although it is uncontroversial that there is something wrong with begging the question, it is not clear from those definitions what is wrong. (shrink)

O objetivo deste artigo é pensar como a relação entre o mundo dos antepassados e o mundo dos vivos se estabelece e se estrutura por intermédio do ritual de ukanyi. Proposta esta que remete ao estudo e compreensão da religiosidade tradicional africana, na qual se assenta a cosmovisão dos africanos perpassada por um sistema de valores, crenças e práticas bantu. Assim, o método etnográfico e a análise situacional aparecem como alicerces para compreender o fenômeno em causa. Considero o pressuposto de (...) que o ritual de ukanyi é uma cerimônia que permite a exaltação dos antepassados, ativa e reativa valores, crenças e práticas que fortalecem e revigoram a religiosidade tradicional africana. Dessa forma, o mesmo nos possibilita vivenciar e experimentar dois mundos diferentes, dos vivos e dos mortos. Entendo que compreender a relação entre o mundo dos vivos e dos antepassados é adentrar na forma como se constituem as afrofilosofias que permitem tangenciar o universo africano.
